Survival Benefits Plan (SBP) and Divorce

Today on Veterans Day, we honor those who have served in the U.S. Armed Forces. I thank them and their families for their courage and sacrifices. I am a Family Law attorney who represents military service members, as well as their spouses. I understand the challenges my clients face during the divorce process. The Survival Benefit Plan (SBP) is an important benefit that is often overlooked by parties. Knowing how and when to make the SBP elections is crucial for the Retired military member, active service members, and spouses going through a divorce process. Defense Finance and Accounting Services (DFAS) provide specific forms and timelines for SBP elections pursuant to divorce. Military members and their spouses considering or in the process of divorce need to know the details and rules regarding the Survival Benefit Plan.
